User Content
ArtRapid offers end users the ability to submit user content in the form of images, comments and reviews. ArtRapid does not pre-screen any user content, but reserves the right to remove, disallow, block, or delete any user content in its sole discretion. ArtRapid does not guarantee the accuracy, integrity, appropriateness, availability, or quality of any user content, and under no circumstances will ArtRapid be liable in any way for any user content.
Product variation from preview image
The physical product will have the same number and position of lines (strings) as the digital preview. However, there will be minor variations between the two because of
- Color: We do our best to match screen colors to the real world. However, because of differences in lighting and displays, the colors in the product the customer receives may not match what is seen on the display.
- Depth: The digital preview is a two dimensional image. Because of the number of overlapping string passes, the physical product has an inherent three dimensionality. This makes the look of the product change on viewing angle, light and shadows. ArtRapid has added actual product photos to some product pages so that customers can see the effect of shadows of the thread and frame on the wall.
Agreement
Please read this agreement carefully, it sets forth the legally binding terms and conditions for use of the site and services provided by ArtRapid.com
The customer must agree to these terms and conditions before ordering Products from this Site. Please read them carefully.
Definitions and interpretation
In this Agreement, the following definitions shall apply
ArtRapid is a Proprietorship registered under the Maharashtra Shops and Establishments Act, 2017 having its registered office at Pune. The term ‘ArtRapid’ means and includes ‘artrapid.com’ and its authorized representatives.
‘Customer’ means and includes the persons placing an order with ArtRapid. For clarification Customer’s address is defined by the address entered at the time of placing an order and the address of delivery is as entered by the Customer at the time of registering purchase.
“Agreement” means this agreement incorporating any terms set out in our Order Acknowledgement.
“Order” means Customer’s order for Products made via the Site.
“Products” means goods which may be purchased by Customer from the Site.
“Site” means the website at https://artrapid.com/ or any successor site operated by ArtRapid from time to time.
This Agreement
The advertising of Products on the Site constitutes an “invitation to treat” and Customer’s Order for Products constitutes a contractual offer. No contract comes into force between Customer and ArtRapid unless and until ArtRapid accepts the Order.
In order to enter into this Agreement with ArtRapid, Customer will need to take the following steps:
- Place a product from the website into the shopping cart.
- Enter shipping address and phone number.
- Make the necessary payment through ArtRapid’s payment gateway partners.
- Customer must confirm their Order and consent to the terms of this Agreement.
- ArtRapid, after receiving the order and payment confirmation, shall send an acknowledgement to the Customer’s email to confirm the order being processed.
- ArtRapid shall send an Email when the Product(s) ordered are shipped to the Customer.
Please note that ArtRapid will not file a copy of this Agreement. ArtRapid may update the version of this Agreement on the Site from time to time, and ArtRapid does not guarantee that the version Customer has agreed to will remain accessible. ArtRapid therefore recommends that Customer downloads, prints and retains a copy of this Agreement for their record.
The only language in which ArtRapid offers this Agreement is English.
Price and payment
Prices for Products are quoted on the Site. It is always possible that some of the Products listed on the Site may be incorrectly priced. ArtRapid will verify prices as part of the sale procedures so that a Product’s correct price will be stated when Customer pays for the Product. If the payment is done in a currency other than INR, the customer’s bank / card might charge the customer additional currency conversion fees over which ArtRapid has no control.
Payment must be made online at the time of placing the order. ArtRapid may withhold the Products and/or terminate this Agreement if the price is not received from Customer in full, on time, in cleared funds.
Prices for Products are liable to change at any time, but changes will not affect Agreements which have come into force.
Jurisdiction
The agreement is subject to the jurisdiction of courts at Pune.
Indemnity
It is agreed by the Customer / buyer that the Customer / buyer shall indemnify ArtRapid for any loss due to breach of any Intellectual property of Law (including Trade Mark, Copyright) with regard to any information, photograph etc given by the Customer / buyer to complete the order.
The Customer assures that in cases where the purchase of goods through this website shall be used only for personal purposes and resale of any product is strictly prohibited. In case of any resale is carried out by the Customer at a higher rate, the Customer shall carry forward such profits to ArtRapid.
The Customer shall indemnify ArtRapid for losses / cost incurred by ArtRapid in case of illegal use of our products by the Customer or any person acting through him / her as an end user.
Liability
The Customer shall be aware that ArtRapid cannot be held responsible and liable for any violation of law (including local laws of the buyer) with regard to the orders placed by the Customer.
IPR
ArtRapid is not liable for any breach on the part of the Customer in providing any information/photograph which are part of protected Intellectual property based on which the products are made and sold.
Delivery
Orders from India are shipped by Express Parcel and international orders are shipped by International Air Parcel.
ArtRapid will arrange for the Products to be delivered to the address for delivery indicated in the Order.
ArtRapid will use reasonable endeavors to deliver Products on or before the date for delivery set out in its shipping page. However, ArtRapid cannot guarantee delivery by the relevant date. ArtRapid does however guarantee that unless there are exceptional circumstances all Products will be dispatched within 14 days of the receipt of payment.
Risk and title
The Products will be at Customer’s risk from the time of shipping. Ownership of the Products will only pass to Customer after ArtRapid receives full payment of all sums due in respect of the Products (including delivery charges).
Warranties
If Customer receives a product that is damaged or Customer has been sent the wrong product then ArtRapid would replace it, provided Customer contacts ArtRapid within a week of receiving the product. Returns are not granted if Customer changes their mind after purchase and wants a refund.
ArtRapid warrants to Customer that any Product Customer purchases through the Site will be of satisfactory quality.
Customer warrants to ArtRapid that:
- Customer has full authority, power and capacity to enter into this Agreement and that all necessary actions have been taken to enable Customer to lawfully enter into this Agreement.
- Customer is legally capable of entering into binding contracts.
- Customer is at least 18 years old.
- The information provided in the Order is accurate.
- Customer will be able to accept delivery of the Products as contemplated in this Agreement.
Subject to the warranties set out in above, to the maximum extent permitted by applicable law ArtRapid disclaims all warranties with respect to the Products, whether express or implied.
General terms
Images of Products on the Site are for illustrative purposes. The actual Products may differ from such images.
ArtRapid will treat all personal information that it collects in connection with the Order in accordance with the terms of its Privacy Policy. The use of the Site will be subject to these terms and conditions.
This Agreement may only be varied by an instrument in writing signed by both Customer and ArtRapid. ArtRapid may revise these terms from time-to-time, but such revisions will not affect the terms of any Agreement which ArtRapid has entered into with Customer.
If any provision of this Agreement is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement shall remain in full force and effect, and such invalid or unenforceable provisions or portion thereof shall be deemed omitted.
No waiver of any term, provision, or condition of this Agreement, whether by conduct or otherwise, in any one or more instances, will be deemed to be, or be construed as, a further or continuing waiver of that term, provision or condition or any other term, provision or condition of this Agreement.
Customer may not assign, charge, sub-contract or otherwise transfer this Agreement, or any of Customer’s rights or obligations arising under this Agreement. Any attempt by Customer to do so shall be null and void. ArtRapid may assign, charge, sub-contract or otherwise transfer this Agreement, or any of our rights or obligations arising under this Agreement, at any time – providing such action does not serve to reduce the guarantees benefiting Customer under this Agreement.
This Agreement is made for the benefit of the parties to it and is not intended to benefit, or be enforceable by, any other person. The rights of the parties to terminate, rescinds, or agree any amendment, variation, waiver or settlement under this Agreement is not subject to the consent of any person who is not a party to this Agreement.
